STUDYING PROPERTY
This course is about the law relating to things. The Oxford Paperback Dictionary defines ‘thing\' as ‘whatever is or may be an object of perception or knowledge or thought\'. For the law of property, the meaning of the word is not that broad, but it does go beyond physical objects to include non-tangible ‘things\' like songs, ideas, and corporate shares. This subject is concerned not so much with the things themselves, but with the rights people have regarding things. Rights can be divided into two categories: rights in personam and rights in rem (using the Latin words for person and thing). Rights in personam are so called because they are enforced against particular persons without much regard for the things they might have. Rights in rem are rights persons have concerning particular things without much regard for the persons against whom those rights might be enforced.
