In its judgement of 26 February 2015 the Court of Justice of the European Union in Case C-623/13 French Ministry of the Economy and Finance against Gérard de Ruyter, the Court "ruled on a reference to that Court" for a preliminary ruling under Article 267 of the Treaty on the Functioning of the European Union that income from assets can only be rendered subject to social contributions under the legislation of the State where the person concerned is employed or self employed.
