This is a paid add-on for Railworks ( www.railsimulator.com ), for personal use only. Downloads are permitted only from www.digitaltrainmodel.com. Except with the express authorization of DTM, users may not modify this add-on. User may re-paint the model and distribute it, free of charge only, in any web site he desires, provided that user distributes only those files essential to the installation of the re-paint by other users, and not the entire model.
Disclaimer
No elements of Railworks or other free or paid add-ons (texture, sound, blueprints, etc.) were used in this model. This model has been created by DTM from scratch, all of its elements are original, and made specifically for this purpose.
In no event shall DTM be liable for any damages to your computer system suffered in connection with the use, whether correct or incorrect, of this add-on.
Installation

Source text - English This agreement is made on 27th September 2013 between

Developer gives exclusive right to --- to incorporate Developers the assets as specified in the Deliverables section of Appendix 1 (“Assets”) into its products.
The Assets may be incorporated only into products created for use in connection with ---’s products.
Developer will supply in accordance with the schedule in Appendix 1, all files, documentation and other material and advice necessary to enable --- to incorporate the Assets into its products.
Developer will assign to --- all intellectual property rights to the Assets.
Nothing in this clause shall prevent --- from including the Assets in products they create for publication anywhere in the world either directly by --- or through other third party publishers.
--- will pay Developer the fee described in Appendix 1 within 14 days of receipt of a suitable invoice.
Representations and Warranties.
Developer makes the following continuing representations, warranties and covenants to ---:
(a) Power and Authority. Developer has the full power and authority to enter into this Agreement.
(b) Rights. Developer has all necessary rights, title, and interest in and to the Assets to grant --- the rights granted hereunder.
(c) Non-infringement. The Assets when used or exploited in accordance with this agreement do not and will not infringe upon, or misappropriate, any copyright, patent, trademark, trade secret or other proprietary rights of any third party. This warranty shall not apply to any portion of any material created by ---.
--- represents, warrants and covenants to Developer that --- has the full power and authority to enter into this Agreement.
Independent Contractors. --- & Developer are independent companies, and nothing in this agreement will be deemed to place the parties in the relationship of employer-employee, principal-agent, partners or joint venturers.
Unenforceability. If any provision of this agreement is found invalid or unenforceable pursuant to judicial decree, such provision will be enforced to the maximum extent permissible and the remainder of this Agreement will remain in full force and effect according to its terms.
Entire Agreement. This agreement and the exhibit attached hereto state the entire agreement between the parties relating to the subject matter of this agreement and supersedes any and all prior agreements and communications, written or oral.
Modification. No amendment or modification of this agreement may be made except by an instrument in writing signed by both parties.
No Third Party Rights. A person who is not a party to this agreement has no right under the Contracts (Right of Third Parties) Act 1999, or otherwise, to enforce any term of this agreement.
VAT. All sums due under this agreement are exclusive of any applicable VAT or other sales tax.
This Agreement shall be governed by and interpreted in accordance with English law and the English courts will have jurisdiction to resolve any disputes between the parties.

Esta garantía no se aplicará a ninguna parte de ningún material creado por ---.
--- declara, garantiza y promete al Desarrollador que --- tiene pleno derecho y capacidad para celebrar el presente Contrato.
Contratistas independientes. --- y el Desarrollador son empresas independientes, y nada en el presente Contrato será interpretado como dando comienzo a una relación laboral, de agencia, societaria o de joint venture.
Inaplicabilidad. Si alguna disposición del presente contrato fuera declarada inválida o no exigible por sentencia judicial, dicha disposición se hará cumplir con el alcance máximo permitido y el resto del Contrato permanecerá en plena vigencia de acuerdo con sus términos.
Acuerdo integral. El presente contrato y el anexo adjunto constituyen el acuerdo íntegro entre las partes en relación con el objeto de este contrato y reemplaza a cualquier acuerdo o comunicación anterior, ya sea oral o escrito.
Modificación. No se harán modificaciones o enmiendas al presente contrato salvo por instrumento firmado por ambas partes.
Exclusión de derechos de terceros. Las personas que no son parte del presente contrato no tienen derecho bajo la Contracts (Right of Third Parties) Act 1999 (Ley de contratos [sobre derechos de terceros] de 1999), u otra, a exigir el cumplimiento de sus términos.
IVA. Las sumas que se deban según el presente Contrato no incluyen IVA ni otros impuestos sobre las ventas.
