Source text - English Patent attorneys in Australia and New Zealand are registered to practise under a joint registration regime. However, the patent laws of Australia and New Zealand are far from harmonised. There are important differences between the two jurisdictions, some which are explained below.
Is it possible to request expedited examination?
Yes. The Australian Patent Office (IP Australia) is a member of the Global Patent Prosecution Highway (GPPH) program. IP Australia and the European Patent Office (EPO) are also running a bilateral Patent Prosecution Highway (PPH) pilot program, which has been extended to at least June 2022.
Under the GPPH and PPH programs, all claims in the Australian application must sufficiently correspond or be amended to sufficiently correspond to one or more of those allowed claims of the overseas application examined by the office of earlier examination (OEE).
There is also an option to request expedited examination for reasons which may include commercial and legal (infringement), or the invention is in the field of ‘green technology’. No evidence of the reason is required. Also, no corresponding amendments to the claims are required. Examination takes places at the same pace as GPPH and PPH examination, which is within 8 weeks of requesting expedited examination.
Yes. The Intellectual Property Office of New Zealand (IPONZ) is a member of the GPPH program. There is currently no bilateral PPH agreement between the EPO and IPONZ.
IPONZ considers Swiss-type pharmaceutical use claims ‘sufficiently correspond’ to equivalent medical use claims in the allowed overseas application. (methods of medical treatment are prohibited under New Zealand Patent Law).
Expedited examination is also allowed in New Zealand for reasons such as commercial similar to Australia. However, the bar to a successful request is higher than Australia and supporting evidence must be provided.
When is the deadline for placing the application in order for acceptance after issuance of an examination report?
The final acceptance deadline is 12 months from the date of issuance of the first examination report. Australia does not have deadlines for responding to an examination report.

Further, response deadlines are not just for filing any response, the response needs to be a ‘substantive’ response addressing, but not necessarily overcoming, every objection.
