Garame ipoteği - Kanımca, bir borç karşılığı tesis edilen ipotek olabileceği gibi,alacaklıların alacak paylarına göre tesis edilmiş ipotek anlamına da gelebilir. Çünkü "Garamet" kelimesi Mustafa Nihat Özön'ün Osmanlıca-Türkçe sözlüğünde;
1. Borç , 2. Borçluluk, 3. Ödenmesi gereken bir şeyi ödemek, 4. Borcu üleştirme; Borcu yükleme olarak açıklanırken,
Garameten kelimesi de "Herkese haklarına göre eşit olarak üleştirme " olarak yer almakta.
Ben "proportional/ pro rata" cevabı ile altenatif bir çözüm sunmak istedim..
