I have no idea about the rest of the text, but Perhaps the author wanted it to sound like a paradox on purpose. Maybe he's being sacrastic.

A bit of a weird concept It's a bit strange because the "estado de direito" is the "rule of law", and the "estado de exceção" is a case of emergency that requires the suspension of the rule of law. So this would be a satate of emergency under the rule of law, which is a paradox.
