Hello.

I am trying to decide what the best translation for "hijos comunes menores is", as in children born to the same two parents that are getting a divorce. Common children? Children born to both parents?

Context:

Cada uno de los cónyuges queda con autonomía en su vida privada, inclusive para establecer su residencia sin que ninguno de ellos pueda intervenir o interferir en la vida del otro, salvo en caso que sea necesaria su intervención cuando se trate de proteger a los *hijos comunes menores*.

Given Marina's astute comment, perhaps what is needed here is:

the children who are in their legal custody OR the children of whom they share legal custody

Either of these would cover both biological and "non-biological" children. Following Marina, the point here has to do in any case with "legal custody" and not whether there is a biological relationship.

under-age children of the family (BE)

I see the asker is in the US. In the UK, child of the family is a technical term of art, including biological children AND ones treated as part of the family, whether adopted, fostered or not - see comments on the other answers.

Arguably, under-age is not needed, as the legal definition of child is one under-age i.e. 18 in most countries, but perhaps better to ininclude as a child of the family could also be the age of majority. 'Infants of the family' would be a non-starter.
