I am trying to decide what the best translation for "hijos comunes menores is", as in children born to the same two parents that are getting a divorce. Common children? Children born to both parents?
Context:
Cada uno de los cónyuges queda con autonomía en su vida privada, inclusive para establecer su residencia sin que ninguno de ellos pueda intervenir o interferir en la vida del otro, salvo en caso que sea necesaria su intervención cuando se trate de proteger a los *hijos comunes menores*.

: Wouldn't children born to them before they married be included?//But "born of the union" would also leave out any children they had adopted while together. Minor children in common is a standard legal term covering all bases.

Either of these would cover both biological and "non-biological" children. Following Marina, the point here has to do in any case with "legal custody" and not whether there is a biological relationship.
