Source text - Korean 신청인은 신청인의 상표 xxx 및 신청인의 또 다른 상표 xxx의 세계적인 주지•저명성에 비추어 피신청인이 분쟁도메인이름을 등록할 당시에 신청인의 상표 xxx의 존재를 알고서 등록하였음이 분명하다. 피신청인은 분쟁도메인이름을 전혀 사용하지 않고 이른바 소극적으로 보유하고 있다. 신청인의 주지•저명한 상표와 동일한 분쟁도메인이름을 소극적으로 보유하는 것도 부정한 목적으로 도메인이름을 사용하는 것으로 인정한 WIPO 사건 결정사례가 있다. 신청인은 피신청인에게 분쟁도메인이름에 대한 신청인의 상표법 및 부정경쟁방지법 위반의 가능성 등을 내용으로 하는 서신을 보낸 바 있으나 아무런 응답이 없었다. 더욱이 피신청인은 “www.xxxx.com”에 분쟁도메인이름을 판매하려고 올려놓았는데 신청인은 “www.xxxx.com”을 통하여서도 피신청인에게 연락을 시도하여 보았으나 전혀 응답이 없었다. 이러한 무응답도 부정한 목적으로 인정한 WIPO 사건의 결정사례가 있다.
Translation - Italian Alla luce della fama e della riconoscibilità nel mondo dei marchi xxx e xxx di proprietà dell’attore, è chiaro che il convenuto al tempo della registrazione del dominio ha registrato lo stesso sapendo dell’esistenza del marchio xxx. Il convenuto non utilizza affatto il dominio ma soltanto lo mantiene passivamente. Esistono casi di risoluzione da parte del WIPO ove si riconosce che mantenere passivamente domini identici a marchi noti e riconoscibili costituisce un uso del dominio per scopi scorretti. L’attore ha inviato una lettera che prospetta fra l’altro la possibile violazione della legge sui marchi commerciali e della legge contro la concorrenza sleale con riferimento al dominio in questione ma non c’è stata alcuna risposta. Inoltre il convenuto aveva messo in vendita il dominio su www.xxxx.com ma i tentativi di mettersi in contatto con il convenuto tramite www.xxxx.com non hanno avuto alcuna risposta. Anche questa mancanza di risposta è riconosciuta come attribuibile a scopi scorretti in casi di risoluzione da parte del WIPO.
