Česká republika se podobně jako jiné evropské země potýká s relativně vysokou nezaměstnaností (kolem 9 %), která má odlišnou strukturu v jednotlivých oborech. Tyto odlišnosti mají však zatím jen minimální dopady do systémových změn ve školské sféře a nepříliš ovlivňuje přemýšlení žáků a jejich rodičů ve volbě profese či studijní cesty. Proto je v posledních letech věnovaná značná pozornost tématům spojeným s volbou profesní/studijní cesty a kariérnímu poradenství ve školách. Zvláštní pozornost pak přitahují žáci se speciálními vzdělávacími potřebami, neboť jejich „kariérní volba“ bývá obvykle komplikovanější, než u jiných skupin žáků. Pokud jde o děti, resp. žáky kolem věku 15 let, cílem výzkumů bývá obvykle identifikovat hlavní faktory ovlivňující volbu a další aktéry, kteří volbu žáků ovlivňují.
Faktory ovlivňující volbu školy/profese bývají kategorizovány do těchto oblastí (Rousseau & Venter, 2009):
- individuální faktory (zájmy, nadání, osobnostní vlastnosti);
- faktory prostředí (možnosti zaměstnání, požadavky na dovednosti, hodnota práce, potenciál ekonomického růstu …);
- situační faktory (škola, rodina, socio-kulturní proměnné).
Žáci uvádějí, že jejich volba střední školy je nejsilněji ovlivněna školním prospěchem a na dalších místech pak snadnou dostupností a zájmem o obor (Bartoňová, 2011, Friedmann, Lazarová, 2011). Do jaké míry je zájem patnáctiletého žáka skutečně vyzrálý, autentický, reflektovaný a neovlivněný rodičem může vyvolávat celou řadu diskusí. Za nejsilněji působící aktéry jsou totiž považováni rodiče, a to zejména matka, kamarádi a teprve na dalších místech odborníci a učitelé (Lazarová, Friedmann, 2011, Hlaďo, 2010). Kniveton (2004) zdůrazňuje vliv genderu rodičů, kteří plní nejen roli poradců, ale i profesních vzorů pro své děti. Je však zřejmé, že podpora rodičů při kariérovém rozhodování dětí je do velké míry ovlivněna věkem, schopnostmi, samostatností dítěte a také socioekonomickým statusem rodiny (např. David, West & Ribbens, 1994). Rodiče z tzv. střední sociální třídy a s vyšším vzděláním jsou při výběru střední školy pro své děti aktivnější než rodiče s nižším socioekonomickým statusem (srov. např. Bláhová & Přinosilová, 2009). V rodinách ohrožených sociálním znevýhodněním děti nebývají aktivně podporovány ve své volbě, je jim ponechána vysoká míra autonomie a rodiče nezřídka spoléhají na pomoc učitelů (srov. Lazarová, Friedmann, 2011). Podobně podle jiných zjištění sehrává významnou roli kultura rodiny a hodnota práce, kterou rodiče dětem předávají (Fouad & Byars-Winston, 2005). Právě rodiče sociálně znevýhodněných žáků bývají méně připraveni, resp. informováni o možnostech volby a tak je v těchto rodinách zvýšeno riziko nesprávné volby (srov. Hlaďo, 2008). Zajímavé výsledky tedy mohou přinést i výzkumy zaměření na identifikaci některých specifik volby žáků se speciálními vzdělávacími potřebami.
V tomto příspěvku nabízíme dílčí výsledky z výzkumu realizovaného v rámci rozsáhlého výzkumného záměru Speciální potřeby žáků v kontextu Rámcového vzdělávacího programu pro základní vzdělávání, který je realizován na Pedagogické fakultě Masarykovy univerzity v Brně. Pro jednoduchost budeme v tomto textu analogicky používat pojmy žáci se speciální vzdělávací potřebou i žáci handicapovaní, když si jsme vědomi drobných rozdílů v pojmosloví.
Translation - English 1. Introduction
The Czech Rrepublic, like other European countries, faces a relatively high unemployment rate (around 9%), which has a different structure in individual fields. These differences, however, only have a minimal impact on systemic changes in the educational sphere and do not strongly influence pupils' or their parents' choices of education and career. In recent years, considerable attention has therefore been paid to issues relating to choice of occupational/educational path and to career counselling in schools. Pupils with special educational needs attract particular attention because their "career choice" is usually more complicated than other pupils'. In the case of children and adolescents, studies usually aim at identifying the main social and other factors influencing the pupils’ choice.
Factors influencing the choice of school/occupation are usually categorized into the following areas (Rousseau & Venter, 2009):
- personal factors (interests, talent, characteristics of personality);
- environmental factors (possibility of employment, skills requirements, value of work, potential of economic growth, etc.);
- situational factors (school, family, socio cultural variables).
Pupils state that their choice of secondary school is most influenced by their school achievement followed by easy accessibility and interest in the field (Bartoňová, 2011, Friedmann, Lazarová 2011). To what extent the interest of a fifteen year old is really mature, authentic, well-considered, and uninfluenced by a parent may incite a number of discussions. The most influential players are considered to be parents, especially the mother, and friends, followed by experts and teachers (Lazarová, Friedmann, 2011, Hlaďo, 2010). Kniveton (2004) emphasizes the influence of gender of parents, who not only fulfil the role of an advisor, but also an occupational role model for their children. However, it is clear that parents’ support in children’s career decision-making is largely influenced by age, ability, the child's independence, and the family's socioeconomic status (e.g., David, West & Ribbens, 1994). Parents from the middle class and with higher education are more active in choosing secondary school for their children than parents with lower socioeconomic status (cf. e.g. Bláhová & Přinosilová, 2009). In socially disadvantaged families, children are less actively supported in their choices, they are left with a high degree of autonomy, and parents rely to a greater extent on the help of teachers (cf. Lazarová, Friedmann, 2011). Similarly, according to other findings, the family’s and the work-related values that parents transmit to their children play an important role (Fouad & Byars-Winston, 2005). Parents of socially disadvantaged pupils tend to be less prepared or informed about the possibilities, and there is therefore an increased risk of non-optimal choices in such families (cf. Hlaďo, 2008). Interesting findings can also be seen by investigating the choices faced by pupils with special educational needs.
In this paper we present the preliminary results of research conducted within the frame of an extensive research project, Special Needs of Pupils in the Context of the Framework Educational Programme for Basic Education carried out at the Faculty of Education of Masaryk University in Brno. For the sake of simplicity, in this article we will be using the terms pupils with special educational needs and handicapped pupils interchangeably, although we are aware of minor differences in terminology.

English to Czech: Addendum to a Software License Agreement General field: Law/Patents Detailed field: Law: Contract(s)
Source text - English USE OF COMPONENT SYSTEMS BY ENTITIES OTHER THAN LICENSEE.
1. Subject to Third Party first signing Exhibit 1 attached hereto and thereby agreeing to abide and be bound by the terms of this Addendum and the Agreement, Infor grants Licensee, for the period of six (6) months effective upon execution of this Addendum (“Access Period”), a temporary nontransferable right to disclose and allow access to the Component Systems by Third Party to achieve the Purpose.
2. The rights granted to Licensee and Third Party hereunder shall terminate with immediate effect upon expiration of the Access Period.
3. The rights granted to Licensee and Third Party hereunder shall also terminate with immediate effect at the date Third Party becomes a licensee and/ or a competitor of Infor.
4. Infor shall further have the right to terminate this Addendum and Exhibit 1 hereto at any time with written notice in the event Licensee and/ or Third Party is in breach of the Agreement, this Addendum or Exhibit 1 hereto.
5. The Third Party access and use of the Component System is subject to an access fee of [INSERT AMOUNT AND CURRENCY OF ACCESS FEE]. This fee will be invoiced to and will be paid by Licensee. Applicable tax amounts, in particular VAT, are not included in this amount and will also be paid by Licensee. The fee is payable within fifteen (15) days after effective date of this Addendum.
6. For the avoidance of doubt, other than as specified herein and in Exhibit 1 hereto Third Party shall have no other rights under the Agreement. In particular Licensee and Third Party acknowdlege that Third Party shall have no right to access Source Code of the Component Systems.
7. It is agreed between Infor and Licensee that each Third Party user permitted to gain access to the Component Systems shall be considered a User for purposes of determining the total number of User accesses permitted under the Agreement. In the event that the total number of Users permitted to gain access to the Component Systems exceeds the total quantity identified in the Agreement, any Addendum or Order Form thereto, Licensee shall immediately notify Infor and remit to Infor such additional charges as determined in accordance with Infor’s then current policies and procedures.
In the event Licensee is currently on Support, Licensee acknowledges and agrees that Support will be made available solely to Licensee and that Third Party will not be permitted direct access to Infor Support.
Translation - Czech POUŽITÍ KOMPONENTOVÝCH SYSTÉMŮ JINÝMI SUBJEKTY, NEŽ JE DRŽITEL LICENCE
1. S výhradou, že třetí osoba podepíše Přílohu 1 tohoto doplňku, a tím souhlasí, že bude dodržovat podmínky tohoto dodatky a smlouvy a bude jimi vázána, XY držiteli licence udělí dočasné nepřenosné právo poskytnout a umožnit přístup ke komponentovým systémům třetí straně za stanoveným účelem, a to po dobu šest (6) měsíců od uzavření tohoto dodatku („období přístupu“).
2. Práva udělená držiteli licence a třetí osobě na základě tohoto doplňku zaniknou s okamžitou účinností vypršením období přístupu.
3. Práva udělená držiteli licence a třetí osobě na základě tohoto dodatku také zaniknou s okamžitou účinností k datu, kdy se třetí osoba stane držitelem licence anebo konkurencí společnosti XY.
4. XY má dále právo vypovědět tento doplněk a jeho Přílohu 1 písemným oznámením kdykoli, kdy držitel licence anebo třetí osoba poruší tuto smlouvu, tento doplněk nebo jeho přílohu č. 1.
5. Přístup třetí osoby ke komponentovému systému a jeho používání podléhá poplatku za přístup ve výši [VLOŽTE ČÁSTKU A MĚNU POPLATKU ZA PŘÍSTUP]. Tento poplatek bude fakturován držiteli licence a držitel licence ho bude platit. Tato částka nezahrnuje platné daňové sazby, zejména DPH, které také zaplatí držitel licence. Poplatek je splatný do patnácti (15) dnů od data účinnosti tohoto dodatku.
6. Pro vyloučení pochybností nemá na základě smlouvy třetí osoba žádná jiná práva než práva uvedená v tomto dodatku a jeho příloze č. 1. Zejména bere držitel licence a třetí osoba na vědomí, že třetí osoba nebude mít žádná práva na přístup ke zdrojovému kódu komponentových systémů.
7. Mezi společností XY a držiteli licence je dohodnuto, že každá třetí osoba, které byl udělen přístup ke komponentovým systémům, se bude považovat za uživatele za účelem stanovení celkového počtu uživatelských přístupů povolených na základě smlouvy. V případě, že celkový počet uživatelů, kterým je umožněn přístup ke komponentovým systémům, překročí celkové množství stanovené ve smlouvě, některém z jejích dodatků nebo objednávkových formulářů k ní, držitel licence to okamžitě oznámí společnosti XY a uhradí jí další poplatky stanovené v souladu s aktuálně platnými zásadami a postupy společnosti XY.
8. Pokud má držitel licence aktuálně přístup k podpoře, držitel licence bere na vědomí a souhlasí, že podpora bude poskytována pouze jemu a že třetí osoba nebude mít k podpoře poskytované společností XY přímý přístup.

Source text - Slovak Štvrtá hlava – konanie v azylových veciach a vo veciach zaistenia
Potreba osobitnej úpravy konaní v azylových veciach a vo veciach zaistenia je žiaduca nielen vzhľadom na osobu žalobcu, ale i vzhľadom na požiadavku na urýchlené konanie.
V právnej úprave správneho súdnictva v súčasnom Občianskom súdnom poriadku chýba úprava tzv. urgentných vecí (case of emergency), t. j. vecí so špeciálnou právnou úpravou vzhľadom na ich naliehavosť. V tejto súvislosti treba považovať za nevhodné, aby lehotu, v ktorej má súd vo veci rozhodnúť, určovali iné zákony ako procesný predpis.
Preto budú v Správnom súdnom poriadku upravené lehoty na postup súdu:
• lehota na nariadenie pojednávania,
• lehota na odoslanie písomného vyhotovenia rozhodnutia,
• lehota na podanie kasačnej sťažnosti a jej doručenie druhému účastníkovi,
• lehota na predloženie spisu najvyššiemu súdu,
• lehota na rozhodnutie o kasačnej sťažnosti.
V konaní o zaistení bude musieť byť zakotvená aj právomoc správneho súdu nariadiť prepustenie osoby zo zaistenia. Ide o analogickú situáciu ako pri väzbe, kedy sudca musí mať právomoc priamo rozhodnúť o prepustení – čl. 5 ods. 4 Európskeho dohovoru.
V prípade, že konanie na správnom orgáne zostane jednostupňové, dochádzalo by v týchto veciach k odkladu účinnosti rozhodnutia správneho orgánu zo zákona, prípadne obdobne ako vo veciach dôchodkových by rozhodnutie nadobudlo právoplatnosť až doručením rozsudku krajského súdu.
Inak budú na konanie v azylových veciach a vo veciach zaistenia primerane požité ustanovenia o žalobách.
Translation - English Chapter Four – Proceedings in asylum matters and in detention matters
The need for the specific regulation of proceedings in asylum matters and detention matters is desirable, not only with regard to the person of the claimant, but also with regard to the request that the proceedings should be made faster.
The regulation of administrative justice in the current Civil Procedure Code lacks any regulation of so-called emergency cases, which are matters needing special regulation because of their urgency. In this regard, it shall be considered inappropriate that the period in which a court is to decide on the matter be determined by any law other than procedural legal regulations.
The following time limits for the court procedures will therefore be modified in the Rules of Administrative Procedure:
• time limit for ordering a hearing,
• time limit for sending a written copy of the decision,
• time limit for filing a so-called cassation complaint (appeal against a provincial administrative court resolution) and its service to the other party,
• time limit for submitting the file to the Supreme Court,
• time limit for the decision on the cassation complaint.
The detention proceedings shall also incorporate the administrative court's power to order the release an individual person from detention. This is a situation analogous to custody, when a judge must have the power to directly decide on release – Art. 5(4) of the European Convention.
In the event that the proceedings before an administrative body remain as first instance proceedings, this would cause in these matters a postponement of effectiveness of the administrative body's decision provided for by the law, or, similarly to pension matters, the decision would only became effective after the regional court has delivered its judgement.
Otherwise, the applicable provisions on claims shall be applied accordingly on proceedings in asylum matters and detention matters.
